Abstrakty

Licznie zachowane na piśmie kontrakty pochodzące z Mezopotamii i Syrii pokazują, że podobnie jak dzisiaj, jedną z najważniejszych trosk kontrahentów było zapewnienie wykonania zobowiązania. Służyły temu między innymi klauzule ustanawiające kary umowne za niewykonanie, nienależyte wykonanie lub podważanie umowy, a także zabezpieczające przed roszczeniami ze strony osób trzecich. Jednakże, pomimo pozornej obfitości źródeł, wiedza na temat prawa zobowiązań tej epoki nie jest pozbawiona poważnych luk. (fragment tekstu)

The aim of the article is to present ways of securing the irrevocability of a contract, used in ancient Near Eastern law. They can be analyzed mostlyon the basis of sale docurnents, which are the most nurnerous extant contracts. Usually, claims by the parties themselves, their kilth and kin, as well as by third person s are forbidden by so-called irrevccability clauses. Oath, corporal and financial penalties are used separately or jointly to protect the agreement. Although the penalties are sometimes extremely harsh, it does not mea n that they were not enforced; in this was the case, they would very quickly lose their preventive force. (original abstract)
