Prawo do pokoju zostało wyróżnione w doktrynie jako jedno z tzw. praw solidarnościowych (solidarity rights), obok prawa do rozwoju, prawa do środowiska, prawa do wspólnego dziedzictwa ludzkości. Wszystkie te prawa miały stanowić trzecią generację praw człowieka i być kolejnym naturalnym etapem rozwoju praw człowieka. Choć koncepcja generacji praw człowieka została szeroko skrytykowana w literaturze i w zasadzie odrzucona, to idea praw solidarnościowych nie zanikła. W ostatnich latach, przede wszystkim na forum Rady Praw Człowieka, zintensyfikowano wysiłki nad określeniem treści i statusu prawa do pokoju oraz sposobów jego wdrażania. Warto więc przyjrzeć się idei prawa do pokoju i spróbować dookreślić jego zakres, charakter oraz ocenić jego przydatność. Głównymi celami niniejszego artykułu jest po pierwsze, określić źródła prawa do pokoju, po drugie, wyznaczyć zakres tegoż prawa, po trzecie, wskazać miejsce prawa do pokoju w katalogu praw człowieka oraz ocenić możliwości jego implementacji. Powyższym zadaniom odpowiada struktura artykułu. Zrealizowanie powyższych celów pozwoli odpowiedzieć na zasadnicze pytanie, czy w istocie doszło do wyodrębniania prawa do pokoju jako prawa człowieka, czy jego wyróżnianie ma sens, i jakie prawa oraz obowiązki z jego realizacją się wiążą. Głównym źródłem badań są dokumenty takich organów ONZ, jak: Zgromadzenia Ogólnego, nieistniejącej już Komisji Praw Człowieka, Rady Praw Człowieka, a także ustalenia doktryny. (fragment tekstu)

The article concerns the normative character of the right to peace and in consequence its status as a human right. The first part of the article discusses legal sources of the right to peace; the second one concerns the content of the right, including description of the right holders and duty bearers; finally the third part treats the legal status of the right to peace in the light of other human rights. The author underlines that peace and human rights are interlinked. There is no peace without respect for human rights and human rights cannot be fully protected in case of deficiency of peace. This fact is recognized in several international agreements including the UN Charter. However, according to the author, the so-called right to peace has not achieved the status of a human right yet. The right to peace as such can be qualified as an emerging right or just aspiration, but not as a human right for which respect is guaranteed by binding international law. The author claims that the concept of the right to peace is useless and attention shall be focused on improving the implementation of already recognized human rights. This solution would paradoxically better serve the protection of the right to peace because this right is and will be protected in international law, but as a right to life, to security and as other human rights. Inclusion of the right to peace into the HR catalogue can have a destructive effect on the HR system because it will provoke further questions about lack or even impossibility of implementation of this right and inconsistency of the whole system because of the specific character of the right to peace.
