Abstrakty

Protokół z Kioto jest uzupełnieniem Ramowej konwencji Narodów Zjednoczonych w sprawie zmian klimatu z 1992 r. Należy pamiętać, że jest to konwencja ramowa, inicjująca rozwiązywanie globalnego problemu zmian klimatu i tworząca "ogólną architekturę" reżimu zmian klimatu, jednak bez nakładania na państwa-strony zobowiązań w sprawie redukcji emisji gazów szklarniowych, a przecież tylko w ten sposób można zrealizować cel konwencji w postaci stabilizacji koncentracji gazów szklarniowych. Regulacje takie bywają metaforycznie nazywanymi "bez zębów". Z kolei w Protokole z Kioto, który został przyjęty w 1997 r. i wszedł w życie 16 lutego 2005 r., na grupę państw rozwiniętych, określonych w aneksie nr I do wymienionej konwencji, nałożono zobowiązania w zakresie redukcji emisji gazów szklarniowych. Cele te miały być zrealizowane w latach 2008-2012, a Protokół z Kioto po tym okresie miał być zastąpiony nowym protokołem. Jednakże do końca 2012 r. nie udało się wynegocjować "następcy" Protokołu z Kioto, stąd też w czasie konferencji stron konwencji klimatycznej (COP-18) w Durbanie w 2012 r. podjęto decyzję o przedłużeniu jego obowiązywania do 2020 r. Oznacza to dodatkowy czas na wynegocjowanie nowych regulacji. (fragment tekstu)

The Kyoto Protocol, signed in 1997, is a "complement" of the United Nations Framework Convention on Climate Change of 1992. The protocol, not the convention, imposed on a group of developed countries obligations on the reduction of greenhouse gas emissions. However, the aim of the article is not an analysis of a final effect of negotiations which are the regulations contained in the Kyoto Protocol, but the analysis of the negotiation process. The hypothesis stating that solving global environmental problems, including climate changes, is a dynamic and more and more complex process, or even "an endless chain of negotiations", was put to verifi cation. Assuming that the Kyoto Protocol negotiations were a complex, dynamic process, to put them in order and at the same time capture the dynamic, thrashe stages which contributed to the final text of the document were identified. The first stage focused on defining the problem, and more precisely determining the scope of issues to be addressed in the protocol. During the second stage interests of states and their positions on the reduction of greenhouse gas emissions were defined. The third stage was a complex process of negotiating a political consensus confirmed by the agreed text of the protocol. (original abstract)
