Abstrakty
Obszary chronione Natura 2000 wzbogaciły katalog narzędzi ochrony przyrody w Polsce. Ta forma ochrony przyrody weszła w życie 1 maja 2004 roku. Wynikało to z faktu członkostwa Polski w Unii Europejskiej oraz obowiązku transpozycji do polskiego systemu prawnego wymogów i programów unijnych w zakresie ochrony przyrody. Zasady powoływania i funkcjonowania obszarów Natura 2000 określa ustawa z dnia 16 kwietnia 2004 r. o ochronie przyrody3. Zobowiązuje ona właściwe organy administracji rządowej i samorządu terytorialnego do wydawania szczegółowych rozporządzeń wykonawczych odnośnie realizacji obszarów Natura 2000. Procedura wyznaczania obszarów Natura 2000 jest bardzo skomplikowana. Powoływanie tych form ochrony przyrody oznacza trudności dla planowania przestrzennego, ich realizacja wymaga skomplikowanych negocjacji z samorządami terytorialnymi i właścicielami terenów dla uzyskania ich zgody na ich powstanie i wprowadzanie do planów zagospodarowania przestrzennego. In 2004, the Natura 2000 protected areas enriched the catalogue of natural protection instruments in Poland. The procedure for determining these forms of protection is veiy complicated and creates problems in the area of spatial planning. Their implementation requires complex negotiations with local authorities and land owners in order to obtain their acceptance of the design and implementation as part of the spatial management plan. Requirements of the protection plans of the Natura 2000 areas should be taken into consideration at the time of design of the sector planning documents and not only during the decision making process on the investment location. Currently, among the available legal solutions, there is no formal and essential basis to determine the influence of the documents of the spatial planning system on the network of the Natura 2000 areas. As part of the currently binding spatial planning system, the significance of the study of conditions and directions of community spatial management should be reinforced because it comprises a complete administrative community area as well as determines the long term spatial development policy. Thus, this document should refer to the Natura 2000 areas. Furthermore, there is a need to introduce environmental impact assessment forecasts into the study of conditions and to make these forecasts available for public inspection alongside the project itself (original abstract)
