Kontrola legalności zatrudnienia przeszła w Polsce na przestrzeni prawie dwudziestu lat pewną ewolucję. W artykule przedstawiono wyniki tej kontroli w latach 2010-2012.

It can been observed that through almost 20 years, the inspection of legality of employment in Poland has been evolving. Passing a bill on the National Labour Inspectorate in 2007, along with delegating all actions regarding the inspection of legality of employment to its competences, has triggered discussions in doctrine by splitting representatives to advocates and opponents of the mentioned above change. The main objective of this paper is the attempt to determine, whether actions taken by National Labour Inspectorate are effective in overcoming the illegal employment in Poland. The author has also analysed the method of determining NLI's competences for inspection of legality of employment, in order to evaluate its activities' efficiency in combating illegal employment. This publication focuses also on the comparison between objective scope of inspection resulting from the Act on the National Labour Inspectorate and the definitions resulting from the Act on employment promotion and labour market institutions. These considerations take into account the subjective aspect of inspection, as well as a brief characteristic of the elements of inspection's procedure, which seems to be questionable. The analisys of results of legality of employment inspection, which was conducted by NLI between 2000-2012, was designed to be an indicator of NLI activities' effectiveness in this area. Moreover, the author has presented exemplary solutions that could improve the effectiveness of actions taken by NLI in the field of legality of employment inspectation. (original abstract)
