Abstrakty

Rozważania w przedmiocie dopuszczalności nadawania imion w systemie prawa niemieckiego zacząć należy od stwierdzenia, że niemieckie prawo administracyjne nie zawiera istotnych ograniczeń w zakresie nadawania imion dzieciom. Odpowiednikiem polskiej ustawy z 1986 r. Prawo o aktach stanu cywilnego, regulującej te kwestie, jest niemiecka ustawa Personenstandsgesetz (PStG) z 3 listopada 1937 r., obowiązująca po licznych zmianach. W oparciu o § 18 niemieckiej ustawy, urodzenie dziecka winno zgłosić się właściwemu urzędowi stanu cywilnego w ciągu tygodnia od tego zdarzenia (urodzenia martwe - w ciągu trzech dni). Na podstawie § 21 PStG do aktu urodzenia wpisuje się między innymi imiona i nazwisko dziecka, miejsce i dzień (także godzinę i minutę) urodzenia, płeć dziecka oraz dane rodziców. (fragment tekstu)

The author discusses in his article a problem of legal admissibility of giving names in the system of German law on background of numerously chosen courts' judicial decisions and moderate comparative formulation in relation to the Polish legal norms. In particular the author presents the notion of a name and tries to formulate synthetically problems occurring on the ground of giving names against the lack of normative limitations in German law in this scope. Considerations in the discussed area are contained in sev-eral subject groups, relating to: an admissible number of names, a possibility of distinguishing a man's sex in relation to a possessed name, admissibility of using ridiculing, obscene, fantastic names, borrowed from proper names and name neologisms and admissibility of using names sounding as surname as well as diminutives and abbreviations of names. Considering the men-tioned problems, the author comes to a conclusion that lack in German law of provisions in any way regulating or limiting giving names to children, causes the same great interpretation problems as extended provisions in the system of Polish law in this area. The author states that though in the system of German law a choice of name for a child is legally unlimited, legal problems originating on this background often cause a necessity of courts' intervention which however do not guarantee uniformity in the objective scope.
