Abstrakty

Problem gwarancji i przestrzegania praw osób niepełnosprawnych i standardów podejścia od nich należy wyłącznie do sfery regulacji krajowych. Celem artykułu jest przybliżenie podejścia europejskiego, w szczególności na gruncie prawa wspólnotowego w ramach Unii Europejskiej. Analiza aktualnie obowiązujących regulacji została przeprowadzona w kontekście zmian na przestrzeni ostatnich lat i ewolucji podejścia w kolejnych dokumentach strategicznych UE. Uwzględniono w tym celu szerszy zakres zagadnienia. Tekst obejmuje także regulacje Rady Europy związane z koncepcją przyjętą przez UE oraz pewne wątki regulacji prawa międzynarodowego publicznego, oddziałujące na podejście reprezentowane przez Unię. Analiza skupia się na istotnej kwestii roli UE w tym obszarze jako instytucji koordynującej, wytyczającej kierunki zmian i wspierającej państwa członkowskie w ich działaniach na rzecz znoszenia barier w osiąganiu społeczeństwa zrównoważonego - dostępnego także dla osób z niepełnosprawnością. For a long time the issues connected to the disability problem have been placed in the sphere of supranational actions including legislation measures. The common approach has a specific significance for Poland as a EU member country. In this paper the attempts for a complex analysis of a contemporary existing legislation have been made in the context of changes and evolution on the ground of subsequent EU strategic documents. The provided analysis focuses on the important issue of the EU role as a coordinating institution that elaborates changes dimensions and supports all actions aimed at fighting barriers towards the sustainable society goals achievement. The conclusions underline the problem of the external regulations influence importance in the sphere of disability, the analysis concerns the most important features of the common EU approach the national competencies domain, the scope of international regulations influence on EU, the unquestioned rules regarding the sphere of antidiscrimination towards disability. The basis for the conducted hereby analysis provided mainly the provisions of the two documents accepted by EU, the Disability Action Plan - DAP) and the continuation in a form of the new common strategy - European Disability Strategy (EDS) as well as many others important for the undertaken issue, for instance the accepted by the Council of Europe Action Plan (AP CE).
