Abstrakty

Zasady odpowiedzialności nieletnich w średniowiecznych prawach Europy były przedmiotem studiów podjętych w rodzimej literaturze historyczno-prawnej. W pionierskiej pracy M. L. Klementowskiego poświęconej tej tematyce swoje miejsce znalazło również określenie wieku dziecka podlegającego odpowiedzialności, zasady odpowiedzialności oraz wymiar i wykonanie kary w stosunku do nieletnich w średniowiecznej Anglii.Niniejszy artykuł podejmuje tematykę odmienną, dotyczącą modelu postępowania karnego w sprawach wszczętych przez małoletnich przed sądami common law. Głównym celem studium jest analiza sposobu realizacji funkcji oskarżenia przez małoletnich oraz przebiegu postępowania w sprawach tego rodzaju. (fragment tekstu)

Although English law tried to restrict infants' ability to prosecute, they playeda significant role in the private prosecution (appeals) of crime. According to common law, an infant is a person under the age of twenty-one years, which is termed his full age. This article analyzes the model of proceedings in private prosecutions brought by infant appellants between the 13th and 18th centuries.(original abstract)
