Abstrakty

Artykuł prezentuje jedno z najmniej znanych i najrzadziej stosowanych rozwiązań regulacyjnych w obszarze inwestycji służących zwiększaniu potencjału sieciowego. Public Contest jest przykładem rozwiązania, które zmierza do odpolitycznienia tego rodzaju decyzji dzięki przekazaniu odbiorcom prawa ich podejmowania. Sam proces podejmowania przez nich decyzji polegał na głosowaniu, przy czym siła głosu poszczególnych odbiorców była uzależniona od rozmiaru korzyści, jaki mogli odnieść w związku z realizacją danego projektu inwestycyjnego. W artykule przedstawiono szerszy kontekst zarysowującego się kierunku reform regulacyjnych, w ramach którego sytuować należy metodę Public Contest, a następnie naświetlono powody, które skłoniły do jej przyjęcia, zarysowano kształt wyjściowej koncepcji regulacji inwestycji w drodze głosowania i kierunki jej ewolucji w argentyńskiej praktyce regulacyjnej, a także przesłanki, które zadecydowały o stopniowym ograniczaniu zakresu jej stosowania.(abstrakt oryginalny)

The paper presents the concept of 'public contest' which is one of the least known methods of regulation. It was part of the market-oriented package of reforms implemented in Argentina's power sector. Its aim was to eliminate the impact of political factors in the investment decisions making process concerning development of transmission networks. Such political factors had led to inefficiency and over-expansion of the Argentinean transmission system. In order to avoid this, the initiative and decision making on transmission expansion were transferred to users. The paper first sets out a broader context of this type of reform, then it outlines the concept of 'public contest', its evolution in regulatory practice and the reasons for gradually diminishing role of this method in the investment decision process.(original abstract)
