Abstrakty

Wciąż trwają negocjacje w sprawie nawiązania Transatlantyckiego Partnerstwa w dziedzinie Handlu i Inwestycji (TTIP), czyli umowy o wolnym handlu, między UE i USA. Autorka omawia spodziewany wpływ porozumienia na miejsca pracy i wynagrodzenia z punktu widzenia zwolenników i przeciwników TTIP, skupiając się na realnych zagrożeniach wynikających głównie z działalności różnego rodzaju lobby oraz rozbieżności między prawem pracy i prawem socjalnym USA i UE. Prezentuje wizję doktryny i propozycję Komisji Europejskiej w sprawie kształtu rozdziału TTIP zawierającego postanowienia w zakresie pracy. Zwraca także uwagę na odtajnione - 9 października 2014 r. - wytyczne dotyczące negocjacji w sprawie TTIP oraz pomysł utworzenia systemu sądów ds. inwestycji w miejsce mechanizmu rozstrzygania sporów między inwestorem a państwem (ISDS). The Transatlantic Trade and Investment Partnership between EU and US is still being negotiated. Its expected impact on jobs and wages is here discussed from different points of view. The author focuses particularly on a real threat emerging mainly from the activity of various lobbies and the discrepancies between the US and the EU labour and social law. The study deals with the shape of the TTIP chapter containing provisions on labour. The author presents the view of the doctrine and the European Commission's proposal. Attention is also paid to - declassified on October 9, 2014 - directives for the negotiation on the TTIP and the idea of introducing the investment court system in place of the investor-state dispute settlement (ISDS) mechanism.
