Abstrakty
The Constitutional Tribunal, with its decision of 29 October 2013 (SK 64/12)1, discontinued the proceedings on lump sum compensation for occupational disease awarded to person covered by the agricultural social insurance who suffered health impairment as a result of conducting non-agricultural business activity. This discontinuation of the proceedings was grounded in Article 39 (1) (1) of the 1 August 1997 Act on the Constitutional Tribunal2, which provides for superfluity or inadmissibility of substantial adjudication. The substantiation of the Tribunal's decision is relatively short but it is worth highlighting that a dissenting opinion was voiced which questions the grounds for the discontinuation. The present gloss, however, is grounded in the importance of the problem which was the subject of the constitutional complaint. (fragment of text)
