Employment Period as a Criterion for Differentiation of Remuneration

W praktyce wyłonił się problem, jak należy podejść do sytuacji, w której pracownik w młodym wieku zarzuca dyskryminację w wynagradzaniu ze względu na wiek, pracodawca zaś chcąc wykazać niezasadność tego zarzutu z powołaniem się na art. 183b § 2 pkt 4 k.p wskazuje, że wynagrodzenia pracowników zostały zróżnicowane w oparciu o staż pracy, który jest dopuszczalnym kryterium różnicowania zasad wynagradzania pracowników. De facto zatem rozstrzygnięcia wymagało, czy powołanie się na kryterium stażu pracy wyłącza potrzebę wykazywania przez pracodawcę innych relewantnych przyczyn zróżnicowania zasad wynagradzania pracowników. Do tego zagadnienia Sąd Najwyższy ustosunkował się w wyroku z 8 grudnia 2015 r., I PK 339/14. Opracowanie jest poświęcone szerszemu omówieniu tego judykatu. (abstrakt oryginalny)
In practice, it emerged the problem, how to approach the situation in which an employee at a young age accuses discrimination in pay onthe ground of their age, and the an employer wanting to demonstrate the justification for that objection with reference to art. 183b § 2 point 4 Labour Code indicates, that the salaries of employees were differentiated on the ground of employment period, which is an acceptable criterion for differentiating the principles of remunerating employees.Therefore, it requires a decision, or refer to the criterion of employment period offs the need to demonstrate by an employer other relevant reasons for the different principles of remuneration. For this issue, the Supreme Court responded in the judgment of 8 December 2015. I PK 339/14. The study is devoted to the wider description of the judgment. (original abstract)
