Abstrakty

Artykuł zawiera wieloaspektową prezentację zjawiska umów wiatykalnych na wtórnym rynku ubezpieczeń na życie. Przedmiotowe kontrakty prowadzą do uczynienia nabywcy wiatykalnego osobą uprawnioną do otrzymania sumy z ubezpieczenia na życie ubezpieczonego w zamian za natychmiastową wypłatę części tej sumy właścicielowi polisy (viatorowi). Analizowany fenomen wywodzi się ze Stanów Zjednoczonych, gdzie w krótkim czasie zaczął odgrywać istotną rolę jako źródło finansowana różnych potrzeb osób znajdujących się w obliczu śmierci. Skala zawierania umów wiatykalnych doprowadziła do powstania zjawisk pokrewnych, w tym przede wszystkim life settlements, których popularność znacznie przekroczyła pierwowzór. Obecnie na wtórnym rynku ubezpieczeń na życie działają liczne wyspecjalizowane podmioty stanowiące o jego specyfice i odrębności. Jednocześnie - z natury rzeczy - wykazuje on szereg podobieństw do rynku ubezpieczeniowego. W pracy omówiono także rozwiązania alternatywne wobec powyższych (np. klauzulę wcześniejszej wypłaty świadczenia przez ubezpieczyciela), jak również uwzględniono amerykańskie rozwiązania normatywne. Wreszcie wskazano negatywne zjawiska wyrosłe na gruncie wtórnego rynku ubezpieczeń na życie. (abstrakt oryginalny)

Paper covers multi-perspective presentation of the viatical settlements on secondary market for life insurance. These contracts are defined as discounted, predeath sale of an life insurance policy, on condition that the seller's (viator's) life expectancy does not exceed twenty-four months. Analyzed phenomenon derives from the United States where, since late eighties of the twentieth century, plays an important role as a financing source of different needs of people in the face of death. The scale of viatical settlements leads to the creation of related contracts and, above all, life settlements, whose popularity has repeatedly exceeded the original. Currently, on the secondary market for life insurance, there are numerous specialized entities which indicates its distinctiveness. Moreover, intrinsically, it shows many similarities to the insurance market. The article also discusses alternative measures, to the mentioned (for example an accelerated death benefit rider), as well as selected US legal solutions in life settlement. Finally, pathological issues associated with the secondary market for life insurance are pointed out. (original abstract)
