The main role of the judiciary is ensuring that the law is obeyed, and adjudicating conflicts between citizens and the state or citizens themselves. One of the fundamental features of the judiciary authority seems to be its independence, which should lead to complete political neutrality of all its institutions and units. It appears, however, that at the beginning of the 21st century most democracies are facing the problem of excessive politicizing of the judiciary authority, which causes considerable difficulty to carrying out its duties and achieving its aims. The politicizing is visible in the process of appointing judges, in the shape of legal norms resulting in weakening the significance of the judiciary authority, as well as in the attempts to influence the judges' decisions. Using the Supreme Court of the United States of America as an example, the author is trying to present the attempts to politicize the judiciary authority which have taken place during the period of two hundred years of American statehood. These attempts have resulted in destabilizing the division of power and the system of control, which form the basis of the Constitution of the year 1787. The other aim of the paper is to show the negative effects of the actions of certain government administrations aiming at diminishing the role of the Supreme Court, whose statements have been forming the American legal and political reality.
