This study examines the validity of the hypothesis of translation universals in English legislative acts. Two hypotheses regarding quantitative features of the acts are tested: the simplification and leveling out. Based on the analysis of a corpus of non-translated and translated texts, the author finds that the latter type of text shows a lower lexical density, a significantly higher proportion of top-frequency words in the total word count, a lower proportion of bottom-frequency words in the corpus, and a lower mean sentence length. In addition, the translational legislative texts are more similar to each other than to non-translational texts with regard to the distribution of most frequent words, and are more alike with regard to sentence length. These findings support the hypotheses of translation features, as applied to the sub-genre of legal discourse. (original abstract)

Niniejszy artykuł przedstawia wyniki badań mających na celu zweryfikowanie hipotezy o uniwersaliach tłumaczeniowych na podstawie angielskich aktów prawnych. Dwie hipotezy dotyczące ilościowych cech tekstów poddano weryfikacji: hipotezę o uproszczeniu tekstu (simplification) oraz konwergencji (levelling-out). Hipotezy te zostały wysunięte przez Baker, która stwierdziła, że teksty będące tłumaczeniami różnią się od tekstów nietłumaczonych, powstałych w naturalnych sytuacjach komunikacyjnych. Baker sugeruje, że cechy te są uniwersalne, a więc niezależne od języka źródłowego. Hipoteza o uniwersaliach tłumaczeniowych zainspirowała wielu badaczy do badań nad różnymi rejestrami języka. Większość tych badań przeprowadzono na tekstach ogólnych. Niniejsza praca koncentruje się na porównaniu tekstów specjalistycznych: korpusów angielskich aktów prawnych dotyczących rynków finansowych. Na podstawie analizy korpusowej autor stwierdza, że tłumaczenia są uboższe pod względem leksykalnym, mają znacznie większy odsetek najczęstszych wyrazów, a mniejszą ilość wyrazów rzadkich. Tłumaczenia są konstruowane w oparciu o statystycznie krótsze zdania. Ponadto, teksty tłumaczone są bardziej podobne do siebie pod względem dystrybucji najczęstszych wyrazów oraz długości zdań niż do tekstów oryginalnych (nietłumaczonych). Wyniki badań potwierdzają zasadność hipotezy o uniwersaliach tłumaczeniowych w zakresie aktów prawnych, stanowiąc dowód na unikatowy charakter tłumaczeń i ich wyraźną odrębność od oryginału.
