The article describes the transfer of personal data to third countries. Data transfer to countries that do not provide an appropriate level of personal data protection within their territories entails a significant risk of prejudice to the rights and freedoms of persons concerned. According to applicable laws, transferring personal data to third countries is allowed if a given country guarantees an appropriate level of personal data protection. The article analyzes the legal acts regulating the transfer of personal data to third countries and the decision of the Court of Justice of the European Union (CVRIA) annulled the Commission decision finding that the United States provides an appropriate level of protection of personal data transferred.
