Abstrakty
Przekazanie możności rozwiązywania problemów energetycznych na grunt lokalny -grunt mikro - w innych państwach europejskich, Stanach Zjednoczonych oraz Australii odniosło nadspodziewany sukces, ożywiło gospodarkę i przyczyniło się do rozwoju konstrukcji społeczeństwa obywatelskiego, poprzez umożliwienie członkom lokalnych społeczności wywierania bezpośredniego wpływu na gospodarkę energetyczną owej zbiorowości. W proponowanym przez autorów Dziale IIIA ustawy Prawo spółdzielcze, poświęconym spółdzielniom energetycznym przyjęto, iż celem spółdzielni energetycznej będzie promowanie oszczędzania energii, budowa bloków energetycznych oraz umożliwianie osobom fizycznym, osobom prawnym oraz osobom, którym ustawa przyznaje zdolność prawną produkcji energii we własnym zakresie. Przygotowany przez autorów projekt ustawy zakłada, iż wytwarzanie energii przez spółdzielnię energetyczną, a także sprzedaż tej energii przez spółdzielnię, z uwagi na cel jakiemu ma służyć, nie będzie działalnością gospodarczą w rozumieniu ustawy o swobodzie działalności gospodarczej. Do spółdzielni energetycznych stosować będzie się także odpowiednio przepisy o mikroinstalacjach, o których mowa w ustawie z dnia 10 kwietnia 1997 r. Prawo energetyczne (Dz. U. 2012, 1059), co umożliwi prowadzenie działalności przez spółdzielnie energetyczne. Zakładanie i rozwój spółdzielni energetycznych powinien odbywać się przede wszystkim we współpracy z samorządem gminnym. Współpraca na tym polu poprzez zaangażowanie sił i środków przyczyni się rozwoju energetyki w Polsce. Działalność ta zostanie wpisana jako zadanie własne gminy(abstrakt oryginalny)
The transfer of energy problems' solving onto the local - micro - ground in other European countries, the United States and Australia ended up with the unexpected success, revived the economy and contributed to the development of civil society, by allowing members of the local community to exert direct influence on the energy economy of this community. In the proposed by the Authors Department IIIA of the Cooperative Law, devoted to energy cooperatives, it is assumed that the objective of energy co-operative will be promotion of energy savings, construction of power units, and enabling individuals, legal persons and the persons to whom the law recognizes the legal capacity production of energy on their own. The bill prepared by the Authors assumes that the production of energy by the energy co-operative, as well as the sale of this energy by the co-operative, due to the objective being pursued, will not be an economic activity in the meaning of the Act on freedom of economic activity. To the energy co-operatives will also apply the provisions of mikro-instalations, referred to in the Act of 10 April 1997. Energy Law (Law Gazette 2012, 1059), which will provide an opportunity for the business of energy co-operatives. Establishment and development of energy co-operatives should take place primarily in cooperation with the municipal government.
