Abstrakty

Celem artykułu jest przedstawienie krajowych i międzynarodowych regulacji praw - nych związanych z przeszkodami w wydaniu towaru pojawiającymi się w toku wyko - nywania drogowego przewozu towarów. Autor przeprowadza analizę obowiązujących przepisów oraz przedstawia pojawiające się problemy interpretacyjne, a także dokonu - je ich własnej oceny. W artykule omówiono ponadto problemy interpretacyjne pojawiające się na gruncie Konwencji CMR w odniesieniu do kwestii uprawnienia przewoźnika do wyładowania towaru na podstawie art. 16 ust. 2 CMR. Autor przedstawia możliwe interpretacje co do zakresu dopuszczalnych czynności oraz ich kolejności. Artykuł zawiera również analizę obowiązujących przepisów krajowych w kontekście ogólnych regulacji doty - czących niemożliwości świadczenia. Ze względu na specyfikę umowy przewozu i brak możliwości stosowania tych regulacji wprost, przy dodatkowym uwzględnieniu wą - skiego zakresu uregulowania kwestii przeszkód w wydaniu, autor zwraca uwagę na ko - nieczność nowelizacji przepisów krajowych w tym zakresie poprzez ich odpowiednie rozbudowanie(abstrakt autora)

The aim of the article is to present the domestic and international regulations concerning the prevention of delivery of goods during the performance of the road carriage. The author conducts the analysis of the applicable provisions of law and presents emerging interpretative issues, stating his own views on these matters. Some attention has been drawn to the interpretative issues arising on the grounds of the CMR Convention, regarding the matters connected with the right of the carrier to unload the goods on the basis of art. 16.2 of CMR Convention. The author describes possible interpretations regarding the scope of the carrier's actions and their order. On the grounds of the domestic law the article contains the analysis of the prevention of delivery in the light of the general provisions regarding the impossibility of performance. Due to the specific character of the contract of road carriage and the lack of possibility to apply these provisions directly, also having in regard the narrow domestic regulations concerning the prevention of delivery, the author highlights the necessity of suitable amendments and development of the applicable provisions.(author's abstract)
