Abstrakty

Celem artykułu jest przedstawienie sytuacji prawnej i społeczno-ekonomicznej ludów tubylczych w Azji. Zgodnie z tym założeniem autorka analizuje kontrowersje związane z definicją ludów tubylczych, a następnie bada wybrane aspekty ich egzystencji (zagadnienia dostępu do terytorium i surowców naturalnych, zdrowia, edukacji). Wybór tematów uzasadniony jest tym, że realizacja praw ludów tubylczych napotyka szereg problemów, także natury prawnej, co w efekcie nie sprzyja poprawie ich sytuacji społeczno-ekonomicznej. The article examines the socio-economic situation of Asian indigenous peoples, especially with respect to their land rights, the right to health and to education. Specific examples are provided and the corresponding legal obligations of states outlined. Also discussed are the controversies over the definition of indigenous peoples in the Asian context.
