Abstrakty

Kanada i Unia Europejska cechują się odmiennym podejściem do żywności genetycznie modyfikowanej. Celem artykułu jest przenalizowanie postanowień Kompleksowej umowy gospodarczo-handlowej (CETA) w zakresie biotechnologii, wskazanie na rozbieżności wynikające ze stosowania zasady zasadniczej równoważności i zasady przezorności oraz przedstawienie możliwych skutków zapisów umowy CETA w zakresie biotechnologii dla rynku Unii Europejskiej, w tym w zakresie zanieczyszczenia niezatwierdzonymi organizmami genetycznie modyfikowanymi. W artykule dokonano przeglądu dostępnych źródeł literaturowych oraz aktów prawnych. (abstrakt oryginalny)

The approach of Canada and European Union towards genetically modified food is distinct. The purpose of this paper is to analyze the regulations of the EU-Canada Comprehensive Economic and Trade Agreement (CETA) in the field of biotechnology, indicate differences that result from the application of the rule of substantial equivalence and the precautionary principle, and present possible effects of CETA regulations in the field of biotechnology for the European Union market, including those that refer to the presence of unauthorised genetically modified organisms. The paper critiques the literature and legal regulations related to the subject. (original abstract)
