Commissions and other Consultative Bodies in Local Governments at the Level of the Voivodeship in Poland and the Region in France - Contribution to the Discussion

As a de lege ferenda conclusion, it is necessary to postulate the creation of advisory commissions in the voivodeship self-government, cooperating as obligatory consultative bodies with the voivodeship executive board, which requires statutory changes. An important element of the consultative policy in the voivodeship self-government also seems to be the establishment of obligatory bodies such as CESER. In the Polish system of self-governmental law, this commission would be tasked with informing the governing body of the effects of regional policy and participating in consultations at the voivodeship level. It would be worth introducing a commission to the organisational structure of the voivodeship that would be an emanation of a legislative body, as in the French regulations, and equip it with similar competences constituting a permanent commission (la commission permanente). It is postulated to introduce in the Polish legislative body, at the voivodeship level, a wider range of committees, commissions and consultative bodies with the participation of the inhabitants of the voivodeship. However, this requires legislative changes that are worth introducing. (original abstract)

Jako wniosek de lege ferenda należy wysunąć postulat utworzenia komisji doradczych w samorządzie województwa współpracujących jako obligatoryjne ciała konsultacyjne z zarządem województwa, co wymaga zmian ustawowych. Istotnym elementem polityki konsultacyjnej w samorządzie województwa wydaje się też powołanie obligatoryjnych ciał, takich jak CESER. Komisja ta w polskim systemie prawa samorządowego miałaby za zadanie informowanie organu stanowiącego o skutkach polityki regionalnej oraz uczestniczenie w konsultacjach na poziomie województwa. Warto byłoby wprowadzić do struktury organizacyjnej w województwie komisję, będącą emanacją organu stanowiącego, na wzór regulacji francuskich, i wyposażyć ją w podobne kompetencje stanowiące jak komisję stałą (la commission permanente). Postuluje się wprowadzenie w polskim organie stanowiącym na szczeblu województwa szerszej gamy komitetów, komisji i ciał konsultacyjnych z udziałem mieszkańców województwa. Wymaga to jednak zmian ustawowych, które warto poczynić. (abstrakt oryginalny)
