The Scope of Application of the Exemption for the Supply of Services by Independent Groups of Persons - after DNB Banka and Aviva Judgments

Wykładnia przepisu wprowadzającego zwolnienie usług świadczonych przez niezależne grupy osób (art. 43 ust. 1 pkt 21 ustawy z 11.03.2004 r. o podatku od towarów i usług1 - dalej u.p.t.u.) od początku jego obowiązywania stanowiła przedmiot sporów. Niemalże każda przesłanka była pojmowana szerzej przez podatników, a węziej przez organy podatkowe. Niektóre spośród użytych w tym przepisie przesłanek były sformułowane w taki sposób, że dziwić mógłby raczej brak sporów interpretacyjnych niż ich występowanie. W 2017 r. Trybunał Sprawiedliwości wydał dwa wyroki dotyczące wzorca rzeczonego zwolnienia z art. 132 ust. 1 lit. f dyrektywy Rady 2006/112/WE z 28.11.2006 r. w sprawie wspólnego systemu podatku od wartości dodanej2 - dalej dyrektywa 2006/112 - DNB Banka i Aviva. Nie wydaje się jednak, aby wyroki te rozwiały wątpliwości interpretacyjne. Mogą natomiast posłużyć ustawodawcy do zawężenia zakresu tego zwolnienia w przyszłości.(abstrakt oryginalny)
The interpretation of the provision that introduced an exemption for the supply of services by independent groups of persons (Art. 43(1)(21) of the Act of 11 March 2004 on VAT) has been disputed from the time it became effective. Almost every criterion was understood more broadly by taxpayers, while more narrowly by tax authorities. Some of the criteria used in the provision in question were formulated in such a way that lack of disputes concerning interpretation would be more surprising than their existence. In 2017 the Court of Justice issued two judgments concerning the model of the exemption in point provided for in Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax (Art. 132(1)(f)) - DNB Banka and Aviva. It does not seem that these judgments can dispel interpretation doubts. Yet they can be used by the legislature to narrow down the scope of this exemption in the future.(original abstract)
