Abstrakty
Celem artykułu jest próba rozwiązania następującego problemu badawczego: czy, i jeśli tak, to dlaczego, regulacja statyczna banków powinna zostać zastąpiona regulacją dynamiczną i jaką rolę w tym procesie mogą odegrać obligacje typu CoCo. Mając na uwadze tak sformułowany problem badawczy, w opracowaniu postawiono następującą hipotezę badawczą: obligacje odwrotnie zamienne (CoCo) wykorzystywane do obniżenia ryzyka bankowego mogą stanowić w sytuacjach kryzysowych ważny instrument w procesie dynamicznej regulacji instytucji sektora bankowego.(abstrakt oryginalny)

The aim of this article is to try to solve the following research problem: whether, and if yes, why static regulation of financial services industry should be replaced or accompanied by dynamic regulations and what role can be played by contingent convertible bonds. Static regulation is proven to be insufficient and becoming inadequate to use in fast-evolving banking. Dynamic regulation brings needed flexibility, framework predictability as well as introduces a decentralized communication mechanism between banks and regulatory bodies. Contingent capital in a form of CoCo bonds serves as a clear regulatory message and raises probability of need for increased supervision and preventive actions. Additionally, use of CoCo bonds increases financial stability of the issuing bank and, in case of immediate conversion, helps in preventing the snow-ball effect of banks' bailouts.(original abstract)
