Abstrakty

Zawieszony strajk, który de facto przybrał formę prawną strajku "włoskiego", potwierdził zgodność regulacji prawnych sporów zbiorowych pracy ze standardami MOP. Ujawnił jednak niezgodność postępowania partnerów społecznych, związków zawodowych i dyrektorów oraz kierowników innych placówek edukacyjnych, oświatowych i wychowawczych, zatrudniających pracowników mających uprawnienia nauczycielskie, z fundamentalną zasadą rozwiązywania sporów zbiorowych pracy przez bezpośrednio zainteresowane podmioty, strajkujących i ich pracodawców. Ujawnił również niedoskonałości regulacji prawnych sformułowanych w Karcie Nauczyciela. Skomplikowana sytuacja prawna uzasadnia podjęcie rzeczywistego dialogu społecznego w oświacie.(abstrakt oryginalny)

The current teachers' general strike is the biggest and the most curious collective action in democratic Poland. It was initiated by the Polish Teachers' Union on April 8th, 2019. The strike confirms the compliance of the Polish legal regulations with the ILO standards. However, it revealed the inconsistency of the behaviour of social partners, trade unions and directors and managers of other educational, educational and upbringing establishments employing employees with teaching qualifications, with the fundamental principle of resolving collective disputes by the directly interested entities, strikers and their employers. The Polish Teachers' Union declared a strike against the state authorities. The state authorities blamed the trade union for immobilising schools. The trade union "Solidarity", which took part in the collective dispute, concluded a separate agreement with the state authorities. The Polish Teachers' Union announced a strike until the day the agreement is concluded. In the election year 2019 the strike can stop the public education system in the country. The situation is complicated and the Author tries to show the benefits and damages caused by the biggest collective dispute.(original abstract)
