Abstrakty

Artykuł przedstawia stan normatywny w przedmiocie zakazu stosowania tortur oraz innego okrutnego, nieludzkiego i poniżającego traktowania, z uwzględnieniem amerykańskich zobowiązań prawnomiędzynarodowych. Istotny element stanowi debata, która odbyła się po atakach z 11 września 2001 roku odnośnie do możliwości zalegalizowania lub uzasadnienia stosowania tortur. Na tle stanu prawnego autorka przedstawia amerykańską praktykę stosowania tortur na przykładzie zatrzymanych w Guantanamo. (abstrakt oryginalny)

This article presents normative state of the prohibition of torture and other cruel, inhuman or degrading treatment taking into account American legal obligations. What is relevant in the article is a debate that took place after the September 11th attacks on the possibility of legalizing or justifying torture. In the light of the legal state the author analyzes American practice of torture taking the example of Guantanamo Bay detainees. (original abstract)
