The Subject-Matter of Legal Regulation in the Act on the Principles of Participation of Foreign Entrepreneurs and Other Foreign Persons in Economic Transactions in the Territory of the Republic of Poland

Abstrakty
Celem artykułu jest wskazanie przedmiotu regulacji prawnej zawartej w ustawie o zasadach uczestnictwa przedsiębiorców zagranicznych i innych osób zagranicznych w obrocie gospodarczym na terytorium Rzeczypospolitej Polskiej. Rozstrzygnięcie tej kwestii pozwoli na określenie zakresu stosowania powołanej ustawy wobec podmiotów zagranicznych. Zwłaszcza, że ustawodawca w przepisach dotyczących zakresu stosowania ustawy posługuje się zwrotami, które nie występują w innych przepisach tej ustawy, oraz przyjmuje błędne założenie, że przedsiębiorcą zagranicznym może być tylko osoba zagraniczna. Zakresem analizy uczyniono rozwiązania, które bezpośrednio określają przedmiot tej regulacji prawnej. (abstrakt oryginalny)
The purpose of the article is to indicate the subject-matter of legal regulation contained in the Act on the Principles of Participation of Foreign Entrepreneurs and Other Foreign Persons in Economic Transactions in the Territory of the Republic of Poland. Resolving this issue will allow us to determine the scope of application of the Act to foreign entities, especially that the legislator in the provisions on the scope of application of the Act uses phrases that do not appear in other provisions of this Act and makes the erroneous assumption that a foreign entrepreneur must be a foreign person. The scope of the analysis includes solutions that directly define the subject-matter of this legal regulation.(original abstract)
