Abstrakty

Artykuł ma na celu sprecyzowanie definicji deklaracji interpretacyjnej i ustalenie znaczenia oraz skutków prawnych tego rodzaju oświadczeń. Po pierwsze, proponuje odmienne niż dotychczas proponowane w doktrynie scharakteryzowanie relacji między pojęciem deklaracji a zastrzeżeniem. Po drugie, omawia główne różnice między deklaracjami interpretacyjnymi i zastrzeżeniami oraz aspekty praktyczne ich stosowania. Po trzecie, omawia wszelkie istotne z punktu widzenia prawa międzynarodowego skutki, które deklaracja interpretacyjna może wywrzeć. Ponadto, artykuł ma na celu przyczynienie się do wznowienia dyskusji naukowej na temat deklaracji interpretacyjnych. (abstrakt oryginalny)

This article's main goal is to precise the definition of interpretative declaration and to establish its importance as well as legal effects of such declarations. Firstly, it proposes a different than proposed up to date in the doctrine characteristic of the relation between an interpretative declaration and a reservation. Secondly, it describes main differences between the interpretative declarations and reservations along with practical aspects of their application. Thirdly, it discusses all the effects relevant from the perspective of international law which may be caused by an interpretative declaration. Moreover, the article's final goal is to contribute to revive the scientific discussion around the interpretative declarations.(original abstract)
