Abstrakty

Świadczenie usług polegających na wykonywaniu pracy w ramach platform zatrudnienia jest jednym z najbardziej rozwijających się zjawisk na globalnym rynku pracy. Status prawny zatrudnionych nie jest prawnie uregulowany. Jest to związane m.in. z tym, że część zatrudnionych rozpoczęła wykonywanie usług w ramach realizacji idei "ekonomii współdzielenia dóbr". Uczestnicy obrotu prawnego odbywającego się z udziałem platform są w większości przypadków uznawani za samozatrudnionych. Nie korzystają więc z żadnych uprawnień pracowniczych i socjalnych. Państwa członkowskie Unii Europejskiej, z nielicznymi wyjątkami, nie podejmują działań zmierzających do uregulowania sytuacji prawnej osób zatrudnionych w ramach platform. Deklaracja podjęta w 2016 r. z inicjatywy central związkowych zmierza do uznania za pracowników tych zatrudnionych, którzy wykonują w ramach platformy pracę podporządkowaną. (abstrakt oryginalny)

The work platform is growing unusually fast due to the necessity to desire to reduce manpower cost and urgency on short terms results. As far as the legal statutes of work platform is concerned a lot of issues remain unsolved. Certain number of people who work for the gig economy has not started for the reason of necessity. Therefore, at the present time there is a lack of clarity concerning platform workers' legal status, their wages and rating mechanism. Almost none of the EU Member State has regulations specifying the employment status of platform workers. The Frankfurt Declaration of 2016 on platform-based work is in favour to ensure that workers on any platform who work under the authority of platform ought to be classified as employees.
