Abstrakty

Przedmiotem artykułu jest analiza działań na rzecz liberalizacji handlu usługami w ramach rokowań prowadzących do ustanowienia Transatlantyckiego Partnerstwa na rzecz Handlu i Inwestycji. Temat został podjęty z uwagi na znaczenie sektora usług w gospodarce Stanów Zjednoczonych i państwach Unii Europejskiej oraz istotność uwolnienia wymiany w tym sektorze dla rozwoju tych gospodarek, a także potencjalne zagrożenia z niej wynikające. Celem opracowania jest analiza stanu rokowań usługowych TTIP, w szczególności opublikowanych dokumentów negocjacyjnych UE. W jej wyniku zidentyfikowane zostaną główne obszary sporne, w przypadku których trudno będzie osiągnąć znaczące zobowiązania liberalizacyjne. Artykuł podzielony został na pięć części. Część pierwszą stanowi wprowadzenie, w którym określono cel artykułu oraz sformułowano tezę, która została poddana weryfikacji. W części drugiej omówiono zakres negocjacji TTIP oraz zaproponowaną strukturę układu. Część trzecia przybliża stanowisko negocjacyjne UE na podstawie upublicznionych zapisów projektu treści układu dotyczącej usług, inwestycji i handlu elektronicznego oraz zaproponowanych zobowiązań szczegółowych zawartych w aneksach dołączonych do tej propozycji. Następnie omówiono sektory, w przypadku których występują defensywne interesy stron, w związku z czym liberalizacja może napotkać większe trudności niż w innych branżach usługowych. Ostatnią część opracowania stanowi podsumowanie zawierające wnioski z przeprowadzonej analizy oraz wskazujące potencjalne korzyści z liberalizacji handlu usługami dla stron porozumienia TTIP.(abstrakt oryginalny)

The aim of the article is to analyse the efforts to liberalise the trade in services as part of the negotiations of the Transatlantic Trade and Investment Partnership (TTIP). This subject has been addressed due to the significance of the services sector for the economy of the United States and the EU Member States as well as because of the considerable impact that liberalisation of trade in this sector would have on the development of the two economies and given the potential threats that could arise from it. The article analyses the state of the TTIP negotiations in the field of services, especially the published EU negotiations documents. The analysis will identify the main contentious areas, in which significant liberalisation commitments will be difficult to achieve. The article has been divided into five parts. Part one is the introduction, which identifies the aim of the article and the thesis that would be verified. Part two describes the extent of TTIP negotiations and the proposed structure of the agreement. Part three presents the EU's position in the negotiations on the basis of the publically available records of the draft agreement, in particular the part thereof that concerns services, investments and electronic trade as well as the proposed detailed commitments included in the annexes to the proposal. Further, the author discusses the sectors in which the two parties have defensive interests and which are therefore likely to encounter greater obstacles to liberalisation than it is the case with other service sectors. The last part of the article is a summary, comprising conclusions from the analysis and pointing out the potential benefits of liberalising the trade in services for the TTIP parties.(original abstract)
