Abstrakty

Artykuł dotyczy przebiegu i rezultatów postępowań antymonopolowych prowadzonych w ostatnich latach przeciwko spółce Microsoft w USA oraz w Unii Europejskiej w sprawach naruszenia przez tę spółkę prawa konkurencji. Analizie pod-dano najpierw cele prawa konkurencji i istotę pozycji dominującej, a następnie zarzuty stawiane firmie Microsoft przez Departament Sprawiedliwości USA oraz argumenty, jakimi posłużyła się Komisja Europejska i Microsoft w niedawno zakończonym postępowaniu wspólnotowym. Artykuł wskazuje na możliwość rozejścia się dróg analizy antymonopolowej pomiędzy USA i Unią oraz przyczyny takiego stanu rzeczy. (abstrakt oryginalny)

The article describes the outcomes of two legal proceedings concerning Microsoft Corp. in respect to breaching competition rules by the company. One of the proceedings in question took place in the US, whereas the other one, in the European Union. Goals and means of the competition rules relevant to this type of cases are being described and - in more detail - accusation by Department of Justice in the US, as well as the process of reaching final judgement in the US, on one hand, and the position of the European Commission, on the other. The arguments brought up by the defendant are also included. Finally, as the conclusions of the two proceedings differ substantially, despite the analyses being similar, remarks on the reasons of such a situation are included.
