Abstrakty

Liberalizacja niemieckiego rynku gazu ziemnego odbyła się opieszale i została określona przez wielu ekspertów - przynajmniej początkowo - jako nieudana. Zmiany ustawowe na płaszczyźnie europejskiej w końcu lat dziewięćdziesiątych XX wieku nie przyniosły wtedy spodziewanego skutku. Przedsiębiorstwa gazowe nie były bowiem zainteresowane aktywną zmianą rynku, z kolei użytkownicy wykazywali niewielkie zainteresowanie poszukiwaniem nowego dostawcy, a izby gospodarcze i związki energetyczne niewiele uczyniły dla szybkiej realizacji procesu liberalizacji. W takich warunkach w końcu lat dziewięćdziesiątych i na początku tego stulecia sytuacja wyglądała tak, jak gdyby niewiele się zmieniło na niemieckim i europejskim rynku gazowym. Jednakże w latach 2010 - 2011 sytuacja jest już inna. Niemiecki rynek gazowy w porównaniu do tego sprzed 10 lat zmienił się bardzo, a zmiany są bezpośrednio związane z konsekwentnym wprowadzeniem liberalizacji. Zasadnicze zmiany miały miejsce w trzech segmentach: na rynkach zakupowych w wyniku wzrostu dostaw, w zakresie transportu dzięki ujednoliceniu warunków przesyłu, w kanałach dystrybucji przez likwidację umów długoterminowych dostaw. The large consolidated energy companies in Germany are known as "the national champions". To support those kind of company structures by the German government would allow to keep the strong negotiation position with the gas producers. This would secure competitive gas price level through the large offtake volume- so the argument of "the national champions" supporters. On the other hand to support the big players on the gas market definitely slow down the gas market liberalisation process and is against the spirit of the fair market competition. The transparency of the market rules and clear access to the gas market and market instruments would replace the strong monopolists on the gas market through the free market price regulated by gas supply and demand. To keep privilege to the big players is therefore contra productive and obsolete. Certain level of regulation is required to ensure the equal gas grid access for the all players (especially small trading companies from abroad). This should be the focus of the German government instead to promote "the national champions". Also the new organisation of the gas market in Germany and its unification should be the role of the Regulation Authority. The role of the German government is also to define the rules for support of renewable energy sources through the tax and subsidy strategy and to increase the administrative efficiency. How to use the German gas liberalization experience in Poland? The structure of the Polish gas market is very similar to the German gas market some years ago. The dominated role of PGNiG, the lack of competition and the development of rules to the gas grid are the main challenges in gas liberalisation in Poland. The distance and reluctance to the private investors in the Polish energy sectors should be overcome. To establish the liquid gas exchange and gas trading hub is the priority on the Polish gas market. The gas supply diversification via LNG terminals and reverse gas flows will support gas market liberalisation in Poland. The long term supply agreements between PGNiG and gas distribution companies should be resolved or cancelled. All contracts with duration longer than 4 years are destructing the free gas market. The goal to support the renewable energy sources in Poland should not be lost in the gal market liberalization process. The promotion of the bio-gas installation in Poland should be deep-seated and fixed in the legislation what will allow long term investments in this sector. (original abstract)
