Odpowiedź na pytanie o wpływ klauzuli napraw na zakres obowiązku odszkodowawczego w ubezpieczeniach komunikacyjnych, jest wypadkową uregulowań prawa ubezpieczeniowego, ogólnego prawa zobowiązań i prawa własności przemysłowej. W niniejszym artykule poruszone zostaną kolejno zagadnienia dotyczące: po pierwsze tego, na czym polega wprowadzona właśnie do polskiego prawa klauzula napraw, po drugie tego, co wynika z przepisów kodeksu cywilnego w kwestii naprawiania szkód w pojazdach, wymagającego użycia części zamiennych i po trzecie tego, jakie skutki dla rynku ubezpieczeniowego ma wprowadzenie klauzuli napraw, a w szczególności, czy wpłynie ona na wspomniane kodeksowe reguły dotyczące naprawiania szkód. The purpose of this article is to present the influence of changes which have recently took place in the Polish law of industrial ownership on the sector of motor insurance. The Law of 29 June 2007 ((The Journal of Laws No. 136, p. 958) amended the law of 30 June 2000. The law on industrial ownership (The Journal of Laws No. 49, p. 508). The changes lie, among others, in the introduction of a series of regulations to it, the aim of which is to break monopoly which gives the entitled person the right resulting from the registration of an industrial exemplar. In the new legal status, the possibility of obtaining the right from the registration of such an exemplar was preserved. However, the position of the entitled subject was significantly receded, and this at the instance of two institutions. One of them is the repair clause, the sense of which is the limitation of the content of the law resulting from the registration of an industrial exemplar in relation to its scope as of before the amendment. The second, however, is the institution of the mandatory licence which creates the possibility of deprivation of the entitled of the exclusiveness in the use of the exemplar. The author describes changes introduced in the area of rights resulting from the registration of an industrial exemplar, also paying attention to certain doubts concerning the constitutionality of the amendment in this scope. One of most important markets influenced by the above mentioned changes is the market of motor spare parts. Particularly, the repair clause should contribute to the development of competition at this market and, what follows, to the decrease of spare parts prices. Undoubtly, the market connected with it is the market of motor insurance, since prices of spare parts for autos translate into the amount of premiums and indemnifications. In the further part of the article the author tries to define a forecasted influence of the repair clause on the sector of motor insurance. This issue is analysed separately for obligatory and voluntary motor insurance. (original abstract)
