Abstrakty
Each time the court deals with another case of hosting provider's liability for copyright infringement, the standards of liability change. However, the most important issues to be assessed remain unchanged: the hosting provider business model and how it responds to the notice-and-take-down procedure of illegal content. Recent years have added a new piece to the puzzle, the Polish ruling in the Ch.pl case.(original abstract)
Za każdym razem gdy sąd rozpatruje kolejny przypadek odpowiedzialności dostawców usług hostingowych za naruszenia praw autorskich, zmieniają się standardy odpowiedzialności. Najważniejsze kwestie będące przedmiotem oceny pozostają jednak niezmienne: model biznesowy host-providera i sposób, w jaki reaguje on na procedurę zawiadamiania i usuwania nielegalnych treści. Ostatnie lata dodały nowy element do układanki, polskie orzeczenie w sprawie największego polskiego serwisu hostingowego Ch.pl.(abstrakt oryginalny)
