Abstrakty

Poniższy artykuł poświęcony został amerykańskiej metodzie partycypacji publicznej zwanej notice and comment. Umożliwia ona obywatelom włączenie się w proces tworzenia przez agencje federalne tzw. regulacji. W tekście zaprezentowano zarówno historyczne, jak i prawne tło tej metody, umożliwiając czytelnikowi zrozumienie roli regulacji w amerykańskiej procedurze administracyjnej, a dzięki temu istotność notice and comment. Autor wskazuje również na podstawę prawną metody, Administrative Procedure Act, oraz jej ewolucję, w tym wpływ nowych technologii. Artykuł podsumowuje refleksja autora na temat kierunku przyszłych badań oraz przydatności metody w kontekście partycypacji publicznej. (abstrakt oryginalny)

The aim of this article is to present the notice and comment procedure, as a method that allows citizens to participate in the rulemaking process in the United States. The text provides a legal and historical background of the method allowing the reader to understand the role of rulemaking in the administrative procedure. The author also points to the legal basis of notice and comments, the Administrative Procedure Act, as well as the evolution of the method including the impact of new technologies. The article summarises the author's reflections on the direction of future research and the usefulness of the method in the context of public participation. (original abstract)
