Abstrakty

Partnerstwo publiczno-prywatne (PPP) stanowi obopólnie korzystną formę współpracy sektora publicznego i prywatnego w realizacji zadań publicznych. W ramach projektów PPP może jednak dojść do udzielenia pomocy państwa zarówno każdemu spośród zaangażowanych w projekt partnerów, jak i odbiorcom usług świadczonych z wykorzystaniem przedmiotu partnerstwa publiczno-prywatnego. W zależności od zastosowanego modelu PPP identyfikacja pomocy państwa w jego ramach wymaga zastosowania reguł pomocy państwa odnoszących się do usług w ogólnym interesie gospodarczym albo kryterium rynkowego operatora. Nowelizacje przepisów o zamówieniach publicznych, a także zmiana sposobu ich stosowania stopniowo prowadzą do podważenia dotychczasowego dogmatu, zgodnie z którym wybór partnera prywatnego w otwartym, konkurencyjnym i niedyskryminującym postępowaniu zapewnia zgodność projektu z regułami pomocy państwa.(abstrakt oryginalny)

Public-private partnership (PPP) is a mutually beneficial form of cooperation between the public and private sectors in the implementation of public tasks. However, State aid may be granted in PPP projects both to each of the partners involved in the project and to the recipients of the services provided with the use of the object of the public-private partnership. Depending on the PPP model used, the identification of State aid within it either requires the application of the State aid rules on services of general economic interest (SGEI) or the market operator test. The amendments of the provisions on public procurement, as well as a change in the method of their application, are gradually leading to undermining the dogma to date, according to which the choice of a private partner in an open, competitive and non-discriminatory procedure ensures the compliance of the project with the rules on State aid.(original abstract)
