Abstrakty
Autor przedstawia przyjętą w Unii Europejskiej specyfikę prawnych warunków zatrudnienia na platformach pracy. Koncentruje się na algorytmie służącym do administrowania pracą zatrudnionych na tych platformach. Analizuje również przepisy o ochronie danych osobowych regulowanych rozporządzeniem 2016/679. Krytycznie ocenia instytucje unijne oraz władze państw członkowskich UE za niepodejmowanie energicznych działań mających na celu stosowanie wobec wszystkich zatrudnionych na platformach ochronnych standardów ILO do osób zatrudnionych i samozatrudnionych. Pozytywnie ocenia uregulowania prawne wprowadzone do systemu prawa europejskiego w rozporządzeniu 2016/679 gwarantujące zatrudnionym na platformach uprawnienia do dostępu do akt osobowych, niepodleganie decyzjom opartym wyłącznie na automatycznym przetwarzaniu danych oraz przenoszenie danych osobowych do innych platform. Wyraża obawę, że ze względu na monopolistyczne zamierzenia platform zatrudnienia uregulowania warunków pracy na tych platformach oraz ochrony danych osobowych mogą nie zostać w pełni zaspokojone.(abstrakt oryginalny)
The author presents the specificity of the legal conditions of employment on employment platforms adopted in the European Union. He focuses on the algorithm used to administer the work of employees on these platforms. The author also analyses the provisions on the protection of personal data regulated by Regulation 2016/679. He criticises EU institutions and the authorities of EU Member States for failing to take vigorous measures to apply the ILO standards on occupational safety and health to all employed and self-employed workers. He positively assesses the legal regulations introduced into the European law system through Regulation 2016/679, which guarantee those employed on platforms the right to access personal files, not being subject to decisions based solely on automatic data processing and the transfer of personal data to other platforms. The author is also concerned that, due to the monopolistic intentions of employment platforms, the regulation of working conditions on these platforms and the protection of personal data may not be fully met.(original abstract)
