Abstrakty

Pomimo że łączną liczbę osób niepełnosprawnych w krajach członkowskich Unii Europejskiej szacuje się aż na 37 milionów1, a połowę z nich stanowią osoby w wieku aktywności zawodowej2, to jednak problem ochrony tych osób przed dyskryminacją w życiu społecznym jak do tej pory nie doczekał się całościowych unormowań w unijnym prawie. Przyczyn tego stanu upatrywać można zarówno w sferze gospodarki (działania zrównujące szanse osób niepełnosprawnych z reguły wymagają nakładów finansowych), w zauważalnym nacisku, jaki w prawie Wspólnot Europejskich oraz prawie Unii położono w pierwszej kolejności na ochronę innych dyskryminowanych grup społecznych3, jak też w fakcie, iż Wspólnoty Europejskie oraz Unia długo nie miały kompetencji do prowadzenia na poziomie wspólnotowym polityki społecznej, w tym polityki w stosunku do osób niepełnosprawnych. Kwestie te bowiem pozostawały i nadal w dużym stopniu pozostają w gestii Państw Członkowskich* 4. Poszczególnych inicjatyw Unii Europejskiej mających na celu zagwarantowanie niepełnosprawnym równości traktowania i równości szans jest jednak, zwłaszcza w ostatnich latach, wiele, a ich znaczenia nie da się przecenić. Niewątpliwie warte są one przypomnienia i przybliżenia. (fragment tekstu)

The problem of the protection of the handicapped people against discrimination in social life has not been completely regulated in the union law despite the fact that the total number of the handicapped people in the member states of the European Union is assessed at 37 millions, and half of them are at the age of professional activity. The reasons for such a state can be found in the field of economy [actions leveling the chances of the handicapped usually require financial expenditure], in the obvious pressure placed on the protection of other discriminated social groups in the law of the European Communities and the European Union, as well as in the fact that the European Communities and the European Union did not have the authority to introduce a social policy at the level of the union in relation to the handicapped people. The issues have been in the hands of the member states. However, there have been many initiatives of the European Union aiming at guaranteeing the equality of treatment and equality of chances to the handicapped people, and their meaning cannot be underestimated. Thus, they are worth recollection and discussion in the following article. It is worth emphasizing that a change of the approach to the problem of the handicapped has been visible both in the initiatives at the union level and in the activities of individual member states. The integration, and the policy towards the handicapped in consequence, is not a separate field of the activity of a state, but an integral part of the social and economic policy. The non-discrimination of the handicapped is not the only basis of integration, but also the equality of chances, a broader concept where a ban on discrimination is just one of the elements. The idea of an independent life is widely promoted. The European Union abandons the same the so far form of care of the handicapped people [e.g. developing the network of social welfare homes]. Instead, attempts at enabling the handicapped a life in own homes, independently or with help from social workers, or personal assistants, regardless of the degree of handicap, are made.
