Abstrakty
Prawo narodów do samostanowienia jest jednym z naj-bardziej niejednoznacznych w prawie międzynarodowym. Kwestia ta miała, i nadal ma, ogromny wpływ na kształtowanie stosunków międzynarodowych oraz międzypaństwowych, a jej ciągła aktualność nakłania naukowców do szczegółowszego zbadania tego tematu. W celu zrozumienia całokształtu zjawiska "stosunków międzynarodowych", bardzo ważne jest zapoznanie się z zasadą samostanowienia Niezwykle trudnym zadaniem jest określenie czym jest samostanowienie narodów, ponieważ praktycznie niemożliwe jest wyciągnięcie z niego uniwersalnej zasady zastosowania. Prawie w każdym przypadku proklamowania prawa do samookreślenia narodowego, wysuwane są różne wymagania i sama idea jest wykorzystywana różnie. Potwierdza to wiele sytuacji konfliktowych: Wielka Brytania i Irlandia Północna, Palestyńczycy i Izrael, Naddniestrze i Mołdawia, Irian i Indonezja, Bośnia i Hercegowina oraz Serbia. The concept of self-determination of peoples is recognized all around the world. It is declared by major sources of inter-national law i.e. International Covenant on Civil and Political Rights of 1966. Its importance is emphasized in the interstate and international agreements, as well as in the declarations adopted by the United Nations General Assembly (UNGA). The issue of self-determination often arises during ethnic conflicts or movements for independence. Taking into account major political events of 19th-20th centuries, it becomes apparent why it has gained increasing importance since then. However, regardless of its importance and commonly accepted construction, the idea of self-determination can be interpreted in many different ways. Consequently, it leads to a number of problems with analyzing the theory and its practical application as well. Thus, the given concept is frequently used by nationalist and separatist movements, which usually result in acute conflicts. The right of peoples to self-determination is one of the most ambiguous subjects of international law. Since this problem was and is of great importance to the development of international and intergovernmental relations, it continues to be studied extensively. It is apparent, therefore, that the principle of self-determination is crucial for understanding the whole concept of international relationship).(original abstract)
