Abstrakty

Międzyamerykański system ochrony praw człowieka ukształtował się w ramach Organizacji Państw Amerykańskich. Statut organizacji, zwany Kartą OPA lub Kartą z Bogoty, został przyjęty na IX Międzyamerykańskiej Konferencji w Bogocie w 1948 r., podczas której została uchwalona także Amerykańska Deklaracja Praw i Obowiązków Człowieka. Na straży przestrzegania norm, praw i wolności na terytorium obu Ameryk stoją Międzyamerykańska Komisja Praw Człowieka oraz Międzyamerykański Trybunał Praw Człowieka, które stanowią główne instytucje międzyamerykańskiego systemu ochrony praw człowieka. Międzyamerykańska Komisja Praw Człowieka powstała w 1959 r. na mocy rezolucji przyjętej na V Konferencji Konsultacyjnej Ministrów Spraw Zagranicznych. Pierwszy statut Komisji, nadany w 1960 r., przyznawał jej szerokie kompetencje, które zostały od tego czasu jeszcze uzupełnione, a pozycja Komisji uległa wzmocnieniu wraz z wejściem w życie Amerykańskiej Konwencji Praw Człowieka. Głównym zadaniem Komisji jest upowszechnianie przestrzegania i ochrony praw człowieka oraz pełnienie funkcji konsultacyjnej w tym zakresie. Jej główną kompetencją jest natomiast możliwość przyjmowania petycji składanych przez osoby indywidualne, grupy osób lub każdą organizację pozarządową uznaną chociaż w jednym państwie członkowskim OPA. Komisja posiada ponad- to prawo kierowania spraw do Międzyamerykańskiego Trybunału Praw Człowieka.(abstrakt oryginalny)

Inter-American system for the protection of human rights was form within the framework of the Organization of American States. The Charter of the OAS, called the OAS Charter or the Bogota Charter, was signed at the Ninth International Conference of American States of 30 April 1948 in Bogota, where the American Declaration of the Rights and Duties of Man was also adopted at the same time. The two principal and autonomous institutions within the Inter-American system are: the Inter-American Commission on Human Rights and the Inter-American Court on Human Rights, whose mission is to ensure the observance of norms, rights and freedoms in the American hemisphere. The Commission was created in 1959 and her first Statute of 1960, granted her broad competences, which have been extended since then. The position of the Commission has been strengthened with the adoption of the American Convention on Human Rights. The main function of the Commission is to promote the observance and protection of human rights and to serve as a consultative organ in these matters. The Commission has the competence to consider the petitions regarding alleged violations of the human rights, lodged by any person or group of persons, or any nongovernmental entity legally recognized in any member state of the organization. The Commission has also the right to refer cases to the Inter-American Court of Human Rights.(original abstract)
