Abstrakty

Celem niniejszego artykułu jest próba rekonstrukcji zasady racjonalnej gospodarki złożami kopalin, jej zdefiniowanie i określenie jej miejsca w systemie prawa. Pozwoli to następnie prześledzić normy prawa polskiego, które odwołują się do niej. Ustalenie treści zasady racjonalnej gospodarki złożem jako zasady prawnej może być przydatne jako wskazówka interpretacyjna dla praktyki administracyjnej i orzeczniczej oraz pomocne w przypadku konieczności rozstrzygnięcia sporów pomiędzy różnymi wartościami prawnymi.(abstrakt oryginalny)

The purpose of this article is an attempt to reconstruct the rule of rational mineral deposit management, to define it and to indicate its place within the legal system. This will allow to review norms of the Polish law which refer thereto. Determining the content of the rule of rational mineral deposit management can be useful as an interpretative guideline for administrative and judicial practice and helpful in case of a need to resolve conflicts between different legal values.(original abstract)
