Abstrakty

Artykuł jest próbą odpowiedzi na pytanie, jakie konsekwencje prawne oraz polityczne wywarła oraz wywrze decyzja 45. prezydenta Donalda Trumpa o uznaniu Jerozolimy stolicą Państwa Izrael, nie tylko w kontekście statusu podzielonego miasta, lecz także konfliktu bliskowschodniego oraz sytuacji w regionie. Jako iż instytucja uznania (oraz nieuznania) jest jedną z najciekawszych koncepcji prawa międzynarodowego, to jej zostanie poświęcona druga - po wprowadzeniu - część artykuły. Dyskusja nad temat uznania Jerozolimy jest niemożliwa bez analizy statusu miasta w świetle prawa międzynarodowego. I choć nie rozpoczęła się ona w momencie ogłoszenia przez Organizację Narodów Zjednoczonych Planu Podziału w 1947 r., to przez wzgląd na ograniczenia związane z charakterem publikacji, rok ten będzie cezurą dla dalszej analizy. W części czwartej prześledzona zostanie polityka Stanów Zjednoczonych względem Jerozolimy ze szczególnym uwzględnieniem kontekstu konfliktu bliskowschodniego. Część piąta - ostatnia, będzie dotyczyć proklamacji prezydenckiej z 6.12.2017 r. i jej skutków politycznych oraz prawnych. Praca łączy w sobie rozważania teoretyczne (analiza uznania w świetle prawa międzynarodowego oraz prawa amerykańskiego) wraz ze studium przypadku działań administracji amerykańskiej (przede wszystkim za czasów prezydenta Donalda Trumpa) względem Jerozolimy.(abstrakt oryginalny)

This article attempts to answer the question as to what legal and political implications the decision of the 45th President Donald Trump to recognise Jerusalem as the capital of the State of Israel has had and will have, not only in the context of the status of the divided city, but also the Middle East conflict and the situation in the region. As the institution of recognition (and non-recognition) is one of the most interesting concepts of international law, the second part - after the introduction - of the article will be devoted to that. The discussion on the recognition of Jerusalem is impossible without an analysis of the city's status under international law. And although it did not begin with the United Nations' announcement of the Partition Plan in 1947, given the constraints of the nature of the publication, that year will be the starting point for further analysis. Part four will trace US policy towards Jerusalem with particular reference to the context of the Middle East conflict. The final part will deal with the presidential proclamation of December 6th, 2017 and its political and legal implications. The paper combines theoretical considerations (analysis of recognition under international law and US law) together with a case study of the actions of the US administration (primarily under President Donald Trump) towards Jerusalem.(original abstract)
