An analysis of metropolises in terms of the system in a comparative perspective is an indispensable part of the discussion on the directions of changes in metropolitan issues in the Polish legal order. Both in Poland and in France, metropolises are becoming an essential element in the implementation of public tasks of a supra-local nature. It is worth noting that the competencies of the constituent and executive bodies of French metropolises, as well as those of the metropolitan association, are very similar, although the range of sub-delegations of competencies in French metropolises is very extensive. The executive body in French metropolises is a monocratic body, standing at the same time at the head of the legislative body, which differs significantly from the collegial structure of the Polish metropolitan association board. The diversity of French metropolitan structures may become a contribution to the new construction of the institution of metropolises in the Polish legal order, based on the categorization of metropolises (from forms of inter-municipal cooperation, through metropolitan unions in their existing legal form, to metropolises with the status of a local government unit, following the example of the Lyon Metropolis). A comparative-legal analysis of the general system assumptions of French metropolises and the metropolitan association in Poland shows great similarities in the competencies of metropolitan bodies in both legal orders, but with a noticeable greater diversity of the organizational structure in the system of French metropolises, which may become an example for Polish metropolitan solutions in the future.(original abstract)

Analiza metropolii w ujęciu ustrojowym w perspektywie porównawczej stanowi niezbędny element dyskusji nad kierunkami zmian w zakresie problematyki metropolitalnej w polskim porządku prawnym. Zarówno w Polsce, jak i we Francji metropolie stają się niezbędnym elementem w realizacji zadań publicznych o charakterze ponadlokalnym. Warto podkreślić, że kompetencje organów stanowiących i wykonawczych metropolii francuskich, jak i organów związku metropolitalnego są bardzo podobne, choć wachlarz subdelegacji kompetencji we francuskich metropoliach jest bardzo obszerny. Organ wykonawczy w metropoliach francuskich jest organem monokratycznym, stojącym równocześnie na czele organu uchwałodawczego, czym w znacznym stopniu różni się od kolegialnej struktury polskiego zarządu związku metropolitalnego. Zróżnicowanie francuskich struktur metropolitalnych może stać się przyczynkiem do nowej konstrukcji instytucji metropolii w polskim porządku prawnym, opartej na kategoryzacji metropolii (od form współpracy międzygminnej, przez związki metropolitalne w dotychczasowej formie prawnej, po metropolie o statusie jednostki samorządu terytorialnego, na wzór Metropolii Lyońskiej). Analiza porównawczoprawna ogólnych założeń ustrojowych metropolii francuskich i związku metropolitalnego w Polsce wskazuje na duże podobieństwa w zakresie kompetencji organów metropolii w obu porządkach prawnych, jednak z zauważalnym większym zróżnicowaniem struktury organizacyjnej w zakresie ustroju francuskich metropolii, co może stać się przykładem dla polskich rozwiązań metropolitalnych w przyszłości.(abstrakt oryginalny)
