Abstrakty

Artykuł dotyczy pracy imigrantów w USA w ośrodkach zatrzymania oraz możliwości kwalifikowania tej pracy jako pracy przymusowej. Podstawowe kwestie, jakie zostały poruszone w artykule dotyczą: wysokości wynagrodzenia otrzymywanego przez osoby osadzone w ośrodkach, zagadnienia czy praca ta ma charakter dobrowolny, jakie są warunki jej wykonywania i wreszcie czy osobom osadzonym w centrach zatrzymania przysługują uprawnienia zbiorowe związane z pracą, a więc prawo do zrzeszania się i efektywnych negocjacji warunków pracy i płacy. Celem publikacji jest przedstawienie dyskusji toczącej się w USA dotyczącej tego, czy osoby osadzone w ośrodkach zatrzymania dla imigrantów podlegają pod dwie fundamentalne regulacje federalne: Ustawę o Uczciwych Standardach Pracy (Fair Labour Standard Act, FLSA), w której znajduje się federalna gwarancja płacy minimalnej oraz Ustawę o Stosunkach Pracy (National Labour Relation Act, NLRA), w której znajduje się gwarancja prawa do zrzeszania się i zakaz dyskryminacji, której podstawą byłoby organizowanie się pracowników lub ich działalność w związku zawodowym zakaz dyskryminacji, której podstawą byłaby działalność związkowa. The paper deals with the work of immigrants in detention centers in the US and the possibility of qualifying this work as forced labor. The main issues addressed in the paper are the amount of wages received by detainees in the centers, the question of whether this labor is voluntary, the conditions under which it is performed and, finally, whether detainees in detention centers are entitled to labor-related collective rights, that is, the right to organize and effectively negotiate working conditions and wages. The idea is to present the ongoing discussion in the US on whether detainees in immigration detention centers fall under two fundamental federal regulations: The Fair Labor Standard Act (FLSA), which includes a federal minimum wage guarantee, and the National Labor Relations Act (NLRA), which includes a guarantee of the right to organize and a prohibition on discrimination based on workers organizing or union activity.
