Abstrakty

Działalność państw, organizacji międzynarodowych oraz innych podmiotów o charakterze pozarządowym realizujących swojo zadania związane z badaniem i eksploatacją przestrzeni kosmicznej stwarza już dziś wiele spornych sytuacji przeradzających się w spory o charakterze międzynarodowym, a nawet powodujących przejściowe napięcia między zainteresowanymi państwami. Różnice interesów zarysowują się na tle ewentualnego wykorzystania przestrzeni kosmicznej dla celów militarnych, a takie na użytek propagandy, która za pośrednictwem bezpośredniej telewizji satelitarnej może przerodzić się w oręż walki ideologicznej. Wiele nierozwiązanych problemów powstaje w związku ze zdalnym badaniem powierzchni Ziemi za pośrednictwem tzw. teledetekcji satelitarnej (remote-sensing).(fragment tekstu)

On the basis of an analysis of the practice of states, drafts of treaty provisions and opinions expressed in the doctrine of international law the author draws the conclusion that at the present stage of the development of space law, the problem of creating adequate conditions for a peaceful settlement of disputes arising from activities in outer space is more strongly associated with the postulate of a development of international law than with an elaboration of the more effective procedures. Comprehension of mechanisms of development processes of the space law should, at the present stage of its development, lead not only to the drafting of procedures of obligatory jurisdiction and introduction of new conventions which may turn out to be premature and limited in their scope of application but also of adoption of resolutions formulating the desirable standards in the development of space law. Such role could be played by unanimous resolutions of the UN General Assembly containing confirmation and extention /progressive development/ of the principles of international law. The so adopted norms will form an integral part of the general corpus iuris spatialis and in this way a basis for the resolution of disputes resulting from activities in outer space.(original abstract)
