Abstrakty

Artykuł dotyczy problematyki związanej z upadłością Sberbank Europe AG. W dniu 24 lutego 2022 roku rozpoczęła się rosyjska inwazja na terytorium Ukrainy. W odpowiedzi państwa członkowskie Unii Europejskiej oraz Unia Europejska bezpośrednio nałożyła sankcje gospodarcze na Federację Rosyjską. Powiązania gospodarcze zostały poważnie zaburzone. Sberbank Europe AG, którego właścicielem był podmiot mający siedzibę na terytorium Rosji, doświadczył poważnych problemów płynnościowych. Europejski Bank Centralny poinformował, że w jego ocenie Sberbank Europe AG i jego dwie spółki zależne w unii bankowej, Sberbank d.d. w Chorwacji i Sberbank banka d.d. w Słowenii są na progu upadłości lub prawdopodobnie upadną (ang. failing or likely to fail, FOLTF) z powyżej wskazanego powodu. Decyzję tę potwierdziła Jednolita Rada ds. Przymusowej Restrukturyzacji i Uporządkowanej Likwidacji. W tekście przeanalizowano działania podjęte przez instytucje sieci bezpieczeństwa w Unii Europejskiej, w Bośni i Hercegowinie oraz Serbii. Szczególne znaczenie w tym aspekcie ma w pierwszej kolejności decyzja o uruchomieniu lub nieuruchomieniu procedury przymusowej restrukturyzacji (ang. resolution). Następnie zwrócono uwagę na zakres użytych narzędzi resolution. Podkreślono znaczenie organów krajowych, w tym systemów gwarantowania depozytów, w procesie zarządzania kryzysowego. W artykule wykorzystano informacje dostępne na stronach internetowych instytucji sieci bezpieczeństwa finansowego, publikacje prasowe oraz sprawozdania finansowe podmiotów grupy Sberbank. The article handles the issues related to the bankruptcy of Sberbank Europe AG. On February 24,2022, the Russian invasion on the Ukrainian territory began. In response to this agression, the Member States ofthe European Union and the European Union us such imposed sanctions on the Russian Federation. Economic ties were seriously disrupted. Vienna-based Sberbank Europe AG, owned by Moscow-based Sberbank of Russia, experienced severe liquidity problems. The European Central Bank announced that, in its opinion, Sberbank Europe AG and its two subsidiaries in the banking union, Sberbank d.d. in Croatia and Sberbank banka d.d. in Slovenia are failing or likely to fail (FOLTF]. This decision was confirmed by the Single Resolution Board. The article characterizes the financial situation of Sberbank Europe AG and its subsidiaries as well as actions taken by financial safety net institutions in the European Union, Bosnia and Herzegovina as well as Serbia, paying particular attention to the decisions to initiate or not to initiate the resolution procedure. The used resolution tools are also the subject of considerations. The complicated and not common system oflegal regimes in individual countries where subsidiaries of Sberbank Europe AG operated required adequate solutions in a very short time. The information and assessments in the article can be the basis for in-depth analyzes, inclu-dingthose focused on the adequacy ofthe solutions provided for in the BRR Directive. (original abstract)
