Abstrakty

W ekonomicznej teorii dóbr publicznych istnieje zjawisko definiowane jako tzw. efekt wolnego jeźdźca, powiązane z pokrewnym zjawiskiem efektu Ringelmanna. W przypadku świadczeń publicznych oba efekty manifestują się w zachowaniu osób, które korzystają z tych świadczeń (np. usług medycznych), choć nie ma do tego uzasadnionej podstawy, a świadczenia te powinny trafić do innych członków społeczeństwa. Badania polskiego ustawodawstwa z lat 2015-2023 ujawniają, że w tym okresie uchwalono również ustawy, których skutki odnosiły się do generowania efektu gapowicza, a nie do jego redukcji. Na podstawie badań procesu legislacyjnego można stwierdzić, że działania polskiego ustawodawcy w zakresie niwelowania efektu gapowicza w obszarze publicznych usług medycznych w latach 2015-2023 okazały się niekonsekwentne.(abstrakt oryginalny)

In the economic theory of public goods, there is a phenomenon defined as the so-called "free-rider effect", which is associated with the related phenomenon of the Ringelmann effect. Both effects manifest in public services through the behaviour of persons who use these benefits (including medical services) without having a justified basis for doing so, and while these benefits should reach other members of society. Studies on Polish legislation from 2015-2023 reveal that during that period statutes were enacted that generated the "free-rider effect" instead of reducing it. Based on studies of the legislative process, it can be concluded that the activities of the Polish legislator in the field of reducing the "free-rider effect" in the area of public medical services in 2015-2023 proved to be inconsistent.(original abstract)
