Abstrakty

Szczególne zagrożenie bezpieczeństwa państwa może skutkować podjęciem środków nadzwyczajnych, których zadaniem jest przywrócenie jego normalnego funkcjonowania. W państwie cyfrowym do realizacji zadań publicznych powszechnie wykorzystywana jest cyberprzestrzeń, dlatego też priorytet działań władz publicznych musi być jej ochrona. Zagrożenia bezpieczeństwa w cyberprzestrzeni mogą mieć niekiedy charakter kwalifikowany, w związku z czym walka z nimi, czy usunięcie ich skutków będzie wymagało wprowadzenia stanu nadzwyczajnego. W związku, z czym jako główny cel przyjęto dokonanie analizy cyberzagrożeń, jako przyczyny wprowadzenia stanu nad- zwyczajnego. W artykule wykorzystano metodę dogmatyczno-prawną oraz teoretyczno-prawną.(abstrakt oryginalny)

A particular threat to state security may result in the adoption of emergency measures aimed at restoring its normal functioning. In a digital state, cyberspace is widely used to carry out public tasks, therefore its protection must be a priority for public autho- rities. Security threats in cyberspace may sometimes be of a serious nature, therefore combating them or removing their effects will require the introduction of a state of emergency. Therefore, the main goal was to analyze cyber threats as the reason for introducing a state of emergency. The article uses the dogmatic-legal and theoretical-legal methods.(original abstract)
