System godziwej rekompensaty wobec postępu technologicznego

Abstrakty

Artykuł stanowi próbę zwięzłego zdefiniowania godziwej rekompensaty w świetle zasad technologicznej neutralności oraz legislacji odpornej na dezaktualizację. W tym celu przedstawiono w nim związek pomiędzy opłatami reprograficznymi a historią medium i postępem technologicznym, dokonano def inicji godziwej rekompensaty sformułowanej na gruncie analizy formalno-dogmatycznej przepisów oraz orzecznictwa Trybunału Sprawiedliwości Unii Europejskiej, a na podstawie analizy porównawczej porządków krajowych z kolei wykazano główne modele godziwej rekompensaty oraz rozwiązania alternatywne. W rezultacie powyższego autor wykazał, iż systemy godziwej rekompensaty oparte na opłacie reprograficznej nie są technologicznie neutralne, a jedynymi logicznymi rozwiązaniami - w świetle tej konkluzji - jest zastąpienie opłat reprograficznych modelem finansowania godziwej rekompensaty z budżetu bądź jej abolicja. The copyright levies are a result of technological progress and are still highly dependant on it. In European law, levies are based on the concept of fair compensation which can be summarized as a sui generis irrebuttable claim of rightholders towards the users of the copyright-protected works under private copying or reprography exception. The claim is caused by the harm caused by such use , taking into consideration the interest of both sides, and is a result as well as the requirement of implementation of private copying or reprography exception. The Member States have high level of f reedom in determining the model of fair compensation which implementation differs from jurisdiction to jurisdiction causing market disruption and legal uncertainty. The model of copyright levies is definitely the dominating solution in European Union. However, in few Member States (Finland, Estonia) we can identify another scheme which is based on state budget compensation. Due to high level of dependency on technology and technological progress, levies are not technologically neutral and not future-proof, thus the author sees two logical solutions to this problem - a shift towards alternative models based on state budget compensation or abolition in the light of changes in consumption of copyright-protected works.
