Abstrakty

Przedmiotem artykułu jest analiza sytuacji prawnej szczątków ludzkich znajdujących się w zbiorach muzealnych. W przypadku tych szczególnych eksponatów konieczne jest pogodzenie interesu społeczności, do których należeli zmarli, których szczątki eksponowano, z potrzebą ochrony dziedzictwa kulturowego i swobodą prowadzenia badań naukowych. W tekście przeanalizowano sposoby repatriacji szczątków z muzeów do krajów pochodzenia, wskazano problemy powstające w związku z ewentualną repatriacją szczątków z polskich muzeów oraz zaproponowano kierunki działań w związku ze stworzeniem reguł repatriacji szczątków, jakie ewentualnie mogłyby się znajdować na terytorium Polski.(abstrakt oryginalny)

The paper analyses the legal issues connected with human remains in museum collections. In the case of these particular exhibits, it is necessary to reconcile the interests of the communities to which the deceased whose remains are displayed belonged with the need to protect cultural heritage, and with the freedom of scien- tific research. The text examines methods of repatriating remains from museums to their countries of origin, identifies issues arising from the potential repatriation of remains from Polish museums, and proposes courses of action towards establishing repatriation rules for remains that may be located within the territory of Poland.(original abstract)
