E-Procurement in Poland, Bulgaria and Romania : an Analysis of Legal Aspects

Nowadays, the majority of companies use electronic procurement for B2B (business-to-business), B2C (business-to-consumer), B2G (business-to-government) purchase and the sale of supplies, work and services through the Internet, as well as other information and networking systems, such as EDI (electronic data interchange) and ERP (enterprise resource planning). The paper contains an analysis of legal aspects of the electronic procurement sphere, including a description of Poland, Bulgaria and Romania. The authors of this paper are citizens of these three countries. That is why these three countries are chosen. The authors of this paper have made content analysis on the basis of public available online resources in English and their native language. This approach allows them to have a deeper look on the available literature. Moreover, as we are in the midst of a reform regarding public procurement in the EU, the European context will be also discussed. The main research method is content analysis on the basis of online documents. As a result of the analysis this paper gives some guidelines concerning the creation of a European knowledge repository and improving the decision making process in e-procurement. Obecnie większość firm korzysta z systemów zamówień elektronicznych w modelach: B2B (business-to-business), B2C (business-to-consumer), B2G (business-to-government). Za pośrednictwem Internetu kupuje i sprzedaje materiały eksploatacyjne, oferuje pracę i usługi. Wykorzystywane są również inne systemy informatyczne, takie jak EDI (elektroniczna wymiana danych) i ERP (planowanie zasobów przedsiębiorstwa). Artykuł zawiera analizę aspektów prawnych w obszarze zamówień elektronicznych w Polsce, Bułgarii i Rumunii. Warto wspomnieć, że kraje UE są w trakcie wdrażania reform dotyczącących zamówień publicznych. Główną metodą badawczą w opracowaniu jest analiza na podstawie dokumentów internetowych.
